SERVICE DELIVERY POLICY

I. GENERAL PROVISIONS

  1. For service packages: oBacker and its affiliated parties shall be responsible for service implementation and delivery of (i) Submitted documents; (ii) Drafted documents; (iii) Results of administrative procedures.
  2. Service delivery results shall be delivered via email. In cases of document delivery, oBacker will deliver directly to customers through postal service or hand delivery.

II. INFORMATION CONFIDENTIALITY AND FILE STORAGE

1.1. oBacker's Confidentiality Commitment

oBacker commits to respecting the confidentiality of all received information and will not disclose to third parties, except in the following cases:

Legal disclosure:

  • When required by law, current regulations, or orders from competent courts;
  • oBacker will endeavor to oppose such disclosure (costs borne by the customer);
  • Notify the customer no later than 1 business day from receiving the order.

Disclosure necessary for service:

  • To advisors, experts, staff, partners necessary for service implementation.
  • Condition: these individuals must have similar confidentiality obligations.

1.2. Personal Data Processing

  • Customers agree to oBacker's personal data policy. Customers guarantee they have obtained consent from personal data subjects before providing such data to oBacker;
  • oBacker has the right to store, process, transfer, and store information on third-party platforms to perform services.
  • Compliance with Decree 13/2023/ND-CP and related guidelines.

1.3. File Storage

  • oBacker may destroy paper files after 1 year from the last invoice;
  • Written notification before destruction;
  • Return customers' original documents upon request.
